By tendering a shipment to ParcelGo, the sender accepts these Terms of Carriage on behalf of themselves and the recipient.
1. Definitions
- Carrier: Neelam Integrated Business Solutions Pvt. Ltd. operating as ParcelGo Domestic Air Express
- Sender: The person or entity tendering a shipment to the Carrier
- Recipient / Consignee: The person or entity to whom the shipment is addressed
- Shipment: All packages tendered under a single AWB number
- AWB: Air Waybill — the document issued by the Carrier as a contract of carriage
2. Contract of carriage
The contract of carriage is formed when the Carrier accepts a shipment and issues an AWB number. These Terms of Carriage form an integral part of that contract and supersede any prior oral or written representations.
3. Acceptance of shipments
The Carrier reserves the right to refuse any shipment at its sole discretion. Shipments tendered after the cut-off time (14:00 hrs same-day, 20:00 hrs next-day) will be processed on the next available service date.
The Sender warrants that:
- The shipment contents are accurately described on the AWB
- The shipment is properly packed and labelled
- The shipment does not contain prohibited items
- All applicable customs, regulatory, and legal requirements have been complied with
4. Prohibited and restricted items
The following are absolutely prohibited:
- Explosives, arms, ammunition, and dangerous goods as classified under DGCA/IATA regulations
- Narcotics, psychotropic substances, and contraband
- Live animals and plants
- Human remains
- Perishables requiring temperature-controlled environments (unless pre-arranged in writing)
- Items that are illegal to transport under any applicable Indian law
- Pornographic or obscene material
The Carrier may inspect any shipment at any time without notice. Shipments found to contain prohibited items will be confiscated and reported to the relevant authorities. The Sender shall bear all costs and liabilities arising from such incidents.
5. Charges and billing
- All charges are calculated on actual or dimensional weight (L×W×H cm ÷ 5,000), whichever is higher
- All rates are exclusive of GST at 18%
- Payment is due at the time of pickup. No credit is extended without a signed corporate account agreement
- The Carrier reserves the right to re-weigh and re-measure any shipment and bill accordingly
- Additional charges may apply for re-delivery attempts, address corrections, or storage beyond 24 hours at destination
6. Delivery
- Same-day delivery: committed by 21:00 hrs at the destination city on the date of acceptance
- Next-day delivery: committed before 12:00 noon on the following calendar day
- Delivery timelines are estimates and not absolute guarantees. The Carrier shall not be liable for delays caused by circumstances beyond its control
- Delivery shall be made to the address stated on the AWB. The Carrier may deliver to any person at the stated address who appears authorised to receive the shipment
- In the event of failed delivery, the Carrier will attempt re-delivery once. Shipments uncollected after 48 hours at the destination facility will be returned to origin at the Sender's cost
7. Liability and limitations
The Carrier's maximum liability for any claim arising from loss, damage, or delay of a shipment is strictly limited to ₹5,000 per shipment.
This limit applies regardless of the actual value of the shipment unless the Sender has declared a higher value at the time of booking and paid the applicable surcharge for additional cover.
The Carrier shall not be liable for:
- Loss or damage caused by improper or insufficient packing by the Sender
- Loss or damage to prohibited or restricted items
- Consequential, indirect, special, or punitive damages of any nature
- Delay caused by force majeure events including strikes, weather, airport closures, government action, or acts of God
- Losses arising from inaccurate or incomplete address information provided by the Sender
- Fragile items unless professionally packed and declared as such
8. Claims procedure
- All claims must be submitted in writing within 24 hours of actual or scheduled delivery
- Claims must be submitted to corporate@parcelgoglobal.com with the AWB number, description of loss/damage, and supporting evidence (photographs where applicable)
- No claim will be entertained after the 24-hour window has elapsed
- Payment of freight charges is a precondition for any claim. Claims will not be processed for shipments with outstanding charges
- The Carrier's decision on claims is final and binding
- Settlement of accepted claims will be made within 30 working days
9. Force majeure
The Carrier shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, government action, DGCA or AAI directives, extreme weather, or airport closures.
10. Governing law and jurisdiction
These Terms of Carriage are governed by the laws of India, including the Carriage by Air Act, 1972 (as amended). Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
11. Severability
If any provision of these Terms of Carriage is found to be unenforceable, the remaining provisions shall continue in full force and effect.
